Business License Frequently Asked Questions (FAQs)

1. Do I need a business license?
If you are receiving monetary compensation for products sold and/or services rendered and your annual gross receipts are over $4,000, you will need a Middlesex County business license.


2. What steps must I take to obtain a business license?
-You will first need to contact the Zoning Department to obtain approval to operate your business or home occupation at the desired location. The Zoning Office is located at 877 General Puller Hwy, Saluda, VA in the Old Courthouse on the 2nd floor. The Zoning Office can be reached by calling (804) 758-4715.

-If your intent is to have an assumed or fictitious name for your business, you will need to file a Certificate of Assumed or Fictitious Name with the Clerk of Court. The Clerk's office is located at 74 Bowden St., Saluda, VA on the 2nd floor of the New Courthouse. The Clerk's office can be reached by calling (804) 758-5317. The fee for this filing is $12.50.

-If you plan to serve prepared food or beverages at your business, you will need to obtain a Meals Tax packet from the Commissioner of the Revenue's office. A food establishment is required to collect a 4% meals tax on any food or beverage that is prepared for sale for consumption by the consumer. The Commissioner of the Revenue's office is located at 877 General Puller Hwy, Saluda, on the 1st floor of the Old Courthouse. -Your Business License is obtained from the Commissioner of the Revenue's office, which is located at 877 General Puller Hwy, Saluda, VA on the 1st floor of the Old Courthouse. You must complete a Business License Application and submit $30 for the License fee.

-Contractors must provide proof of a valid license with the State Board for Contractors. Contractors must also complete a Workman's Compensation Certification form. Out-of-town contractors are not required to obtain a Middlesex County Business License unless the amount of contracts in Middlesex County exceeds $25,000 in the calendar year.



3. How much will the business license cost?
The cost to receive your initial business license is $30.00.


4. When does the license have to be renewed and how much tax will I pay?
Business licenses are valid from January 1 to December 31 each calendar year. Business license renewals will be mailed out in January each year and are due back by March 1 of each year. For all estimated gross receipts of $50,000 or less the tax will be $30.00. For businesses with annual gross receipts greater than $50,000 the fee is based on a percentage of the gross receipts. 5. If I am operating my business out of my home or use my home as my office, do I still need to contact the Zoning office?
Yes, everyone must contact zoning before a business license will be issued. If the business is being conducted from your home you must get permission for a home occupation.


6. If I am an Out-of-town Contractor, do I need a Business License in Middlesex County?
If the total amount of contracts in Middlesex County is over $25,000 in the calendar year, contractors must obtain a business license in the county. Contractors must fill out a Business License application, Worker’s Compensation Contractor’s Certificate and submit a copy of their State Contractor’s License.


7. Do I need an Employer Identification Number (EIN)?
No, your Social Security Number may be used if you prefer not to get an EIN. For information on obtaining an EIN visit www.irs.gov.


8. Do I have to apply for a Business License in person or can I apply by mail/fax?
You can apply for a Business License via mail as long as all required documents (Zoning approval, Fictitious Name certification, Contractor forms) are attached and a check in the amount of $30.00, made payable to Middlesex County, is enclosed. Information should be mailed to: Commissioner of the Revenue’s Office, P.O. Box 148, Saluda, VA 23149.


9. What form do I file to obtain a Sales Tax Identification Number?

10. How do I obtain a Virginia Contractor’s License?
